On May 10, 2024, the Competition Commission of India notified the Competition Commission of India (General) Amendment Regulations, 2024. These regulations amend the provisions of the Competition Commission of India (General) Regulations, 2009, in relation to the treatment of confidential information in the Competition Commission of India proceedings. The Competition Commission of India (General) Amendment Regulations, 2024 traces its basis back to earlier this year when the Competition Commission of India, on February 26, 2024, had invited comments from the public on the draft amendments to Regulations 35, 37, and 50 of the Competition Commission of India (General) Regulations 2009. Earlier in 2022, the Competition Commission of India had amended the Competition Commission of India (General) Regulations, 2009 to introduce the concept of “confidentiality ring” which allowed the parties to access the confidential information or documents of other parties during an investigation. The Competition Commission of India (General) Amendment Regulations, 2024 seeks to further finetune the CCI’s “confidentiality ring” regime.
