The Ministry of Corporate Affairs by way of two separate notifications has brought into force the amended Section 16 of the Competition Act, 2002 and amended the recruitment rules for the Director General (“DG”). The Competition Commission of India is now empowered to appoint the DG, with the prior approval of the Central Government. Additionally, the Central Government has modified the existing recruitment rules by tweaking the composition of the Search-cum-Selection Committee for the appointment of the DG.
