The Standing Committee on Finance (“Committee”) recently tabled its report on the Competition (Amendment) Bill, 2022 (“Bill”) before the Lok Sabha (the lower house of the Parliament). The Committee, after consultation with various stakeholders, recommended meaningful suggestions to the Bill, such as bringing cartels under the scope of settlements, introduction of an ‘effects-based’ test in relation to abuse of dominance cases, extending the intellectual property rights exemption to abuse of dominance cases, etc. INDUSLAW’s Avimukt Dar, Unnati Agrawal, Yash Lahoty, and Hrishav Kumar analyse the key recommendations of the Committee and provide their insights.
