The months of September and October 2025 were significant in India’s energy transition journey and crucial regulatory and judicial developments were also observed in the natural resources and infrastructure sectors. Notably, the draft Electricity (Amendment) Bill, 2025, is the first major proposal to overhaul the electricity laws in almost two decades and it seeks to reform the Indian power sector. Significant changes were also proposed by the draft Electricity (Second Amendment) Rules, 2025, to the requirements for captive generating plants under Rule 3 of the Electricity Rules, 2005, thereby potentially offsetting the regulatory certainty provided by the Supreme Court in its decision in the matter of Dakshin Gujarat Vij Company Limited v. Gayatri Shakti Paper and Board Limited., 2023 SCC OnLine 1276. The National Policy on Geothermal Energy was also notified, which supports development of geothermal energy through incentives.
